Partner Visa (Apply Overseas) – Subclass 309 & 100

The Partner Visa (Offshore) allows the spouse or de facto partner of an Australian citizen, Australian permanent resident, or an eligible New Zealand citizen to live in Australia. Applicants apply for the provisional (Subclass 309) and permanent (Subclass 100) partner visas together.

The Partner Visa (that can be applied overseas) includes:

  • Partner Visa (Provisional) – Subclass 309
  • Partner Visa (Migrant) – Subclass 100
Partner Visa (Provisional) – Subclass 309

The Partner Visa Subclass 309 is the first stage of the offshore partner visa pathway. It allows eligible applicants to live in Australia temporarily while the permanent partner visa (Subclass 100) is being processed.

What Subclass 309 Offers
  • Live, work and study in Australia while the permanent stage is assessed
  • Travel in and out of Australia as needed during the visa validity
  • Free English classes through Adult Migrant English Program (if eligible)
Cost & Processing
  • Visa fee for the main applicant is AUD 9,365 (covers both Subclass 309 & 100)
  • Visa fee for Secondary applicants over 18 fee is AUD 4,685
  • Visa fee for Secondary applicants under 18 is AUD 2,345
Eligibility Highlights: Applicants must generally be 18 years or older, be in a genuine married or de facto relationship,have a partner who is an Australian citizen, permanent resident, or eligible NZ citizen, have a valid marriage under Australian law (if married), and apply while outside Australia.
Partner Visa (Migrant) – Subclass 100

The Partner Visa Subclass 100 is the permanent stage of the offshore partner visa process. It allows eligible applicants to live and work in Australia permanently.

What Subclass 100 Offers
  • Live, work and study in Australia permanently
  • Access Medicare (if eligible)
  • Free English classes through AMEP (if eligible)
  • Sponsor eligible family members
  • Travel facility for up to 5 years from the date of grant
Eligibility Highlights: Applicants must hold Subclass 309, continue to be in a genuine and ongoing relationship, and usually wait until at least two years have passed from the combined 309/100 application for permanent assessment.
