Partner Visa (Apply Overseas) – Subclass 309 & 100
The Partner Visa (Offshore) allows the spouse or de facto partner of an Australian citizen, Australian permanent resident, or an eligible New Zealand citizen to live in Australia. In most cases, applicants apply for the provisional (Subclass 309) and permanent (Subclass 100) partner visas together.
The Partner Visa (apply overseas) includes:
- Partner Visa (Provisional) – Subclass 309
- Partner Visa (Migrant) – Subclass 100
The Partner Visa Subclass 309 is the first stage of the offshore partner visa pathway. It allows eligible applicants to live in Australia temporarily while the permanent partner visa (Subclass 100) is being processed.
- Live, work and study in Australia while the permanent stage is assessed
- Travel in and out of Australia as needed during the visa validity
- Free English classes through Adult Migrant English Program (if eligible)
- Visa fee starts from AUD $7,850 (covers both Subclass 309 & 100)
- Estimated processing: 5 to 29 months (may vary)
The Partner Visa Subclass 100 is the permanent stage of the offshore partner visa process. It allows eligible applicants to live in Australia permanently, after being assessed following the provisional stage.
- Live, work and study in Australia permanently
- Access Medicare (if eligible)
- Free English classes through AMEP (if eligible)
- Sponsor eligible family members
- Travel facility for up to 5 years from the date of grant
- Estimated processing: 12 to 18 months from the date of application (may vary)
- Assessment is based on relationship evidence and ongoing eligibility
